1. the buyer should fully understand the policies of their selected Email Service Provider (ESP) (e.g., Constant Contact, Mail Chimp, or Internal Platform), including acceptable bounce rates, abuse rates, approval of acquired lists, and other restrictions: MailinginfoUSA is not liable for abuse complaints, account suspensions, or other consequences of utilizing the email list. Some email service providers may prohibit purchased lists. Suggestions for ESPs are available upon request. Any extra internal or third-party cleaning, suppressions, or deletions of emails from the given list are not relevant and will not represent the authenticity of the emails. Some third-party or deployment platforms perform their cleansing, which may delete emails from the list and restrict it from being utilized with that specific source.

 

2. Data is sold “as is,” with no warranties or assurances: To be compensated for cases where a more significant bounce rate is observed, the client must communicate to the ENTIRE database. MailinginfoUSA may ask for information on how the email list was utilized, materials delivered bounce list, or other situations surrounding data usage. If the bounce rate surpasses a certain threshold, MailinginfoUSA will give more records (pending bounce list review).

 

3. Once the order documents are returned and payment is finalized, the average processing period for list purchases is 36-72 hours: MailinginfoUSA will contact the customer if the processing time is delayed. The amounts of data purchased/counts received are subject to change during the fulfillment process, and MailinginfoUSA will notify the customer if quantities are low.

 

4. MailinginfoUSA provides no warranties or assurances about email response, open rates, click-through rates, or other email marketing efficiency measurements: Customer agrees to comply with all federal, state, and local laws, including but not limited to rules about the United States’ CAN-SPAM legislation or Canada’s CASL, and at this moment releases NDG from any/all liability associated with Customer’s use of the data provided and Customer’s violation of such laws.

Databases and e-mail marketing operate on the same concept as software: it is considered a final sale once accessed or downloaded. All sales are final and non-refundable due to the nature of the data. By completing your contact information and executing your order, you engage in a legally binding purchase deal.
